The Criminal Code of the Russian Federation, on the basis of which a preliminary investigation was conducted, contained dozens of sections that suited convicting anyone; the most notorious of these was article 58. The judgment was final and was not subject of appeal, and the participation of defense councils in proceedings was initially a rare exception.
